1. Acceptance of terms

If you do not agree with any part of these terms, please do not use the Site. Ecquitofund S.A. reserves the right to modify these terms at any time, and it is your responsibility to review them periodically.

Ecquitofund S.A. is a private company domiciled in the Republic of Ecuador that facilitates the participation of Ecuadorian citizens in investment programs linked to housing projects. Through this Site, we provide general information about such programs and offer a free inquiry channel for interested individuals. The information published on the Site is exclusively informational and does not constitute a binding offer, financial, legal, or investment advice.
3. Eligibility
Housing project participation programs are aimed at Ecuadorian citizens residing in Ecuador, aged between 40 and 65 years. Eligibility verification is carried out on an individual basis and is subject to evaluation by Ecquitofund S.A. and the specific conditions of each project. Meeting the age criteria does not automatically guarantee participation in any program.
4. Nature of the program
The programs offered by Ecquitofund S.A. are of a private nature and do not constitute government programs, state subsidies, or social benefits. Participation in these programs involves the contribution of the participant's own capital, and the specific terms of each program (amounts, deadlines, distributions) are detailed in independent contractual documentation provided prior to the formalization of any commitment.
5. Risks and warnings
Participation in housing projects carries inherent risks that the participant must know and accept before committing. These risks include, but are not limited to: possible partial or total loss of contributed capital; delays in construction or project delivery timelines; variations in estimated distributions due to market, regulatory, or project execution conditions; changes in Ecuadorian legislation that may affect program terms. Past results of previous projects do not guarantee future results. Ecquitofund S.A. recommends that all interested parties seek independent financial and legal advice before making any participation decision.
6. Intellectual property
All content on the Site, including but not limited to text, graphics, logos, images, icons, software, and design, is the property of Ecquitofund S.A. or its licensors and is protected by the intellectual property laws of the Republic of Ecuador and applicable international treaties. The reproduction, distribution, modification, or commercial use of any Site content without the prior written authorization of Ecquitofund S.A. is prohibited.
7. Limitation of liability
Ecquitofund S.A. shall not be liable for direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Site, or from participation in any of the programs offered, to the maximum extent permitted by Ecuadorian law. The information on the Site is provided 'as is' and Ecquitofund S.A. does not guarantee its accuracy, completeness, or timeliness at all times.

Any dispute arising from or related to the use of the Site or the interpretation of these terms shall be submitted to the jurisdiction of the competent courts of the city of Quito, Province of Pichincha, Ecuador, with the parties waiving any other venue that may correspond to them.
11. Alternative dispute resolution
Before resorting to judicial proceedings, the parties commit to attempting to resolve any dispute through good faith direct negotiation for a minimum period of 30 calendar days. If the dispute is not resolved by this means, the parties may resort to mediation before a mediation center authorized in the city of Quito, in accordance with Ecuador's Arbitration and Mediation Law.
